Elite Software Corp. has been informed by the North Carolina Director of Audits & Investigations Real Estate Commissions, that our Escrow Compliance Software complies with the provisions of the North Carolina Real Estate Commissions Rules and Trust Account Guidelines as a real estate earnest money accounting software if the following procedures are followed when using the software:
Please note: to all North Carolina Real Estate Broker Owners in addition to our normal reports that can be derived from our software, North Carolina Real Estate Commission requires (When a single deposit ticket is used to deposit funds collected for more than one sales transaction, property owner, or property, the required information shall be recorded on the ticket for each sales transaction, owner, or property, or the ticket may refer to the same information recorded on a supplemental deposit worksheet which shall be cross-referenced to the corresponding deposit ticket; in addition a journal or check stubs identifying in chronological sequence each bank deposit and disbursement of monies to and from the trust or escrow account, including the amount and date of each deposit and a reference to the corresponding deposit ticket and any supplemental deposit worksheet, and the amount, date, check number, and purpose of disbursements and to whom paid. The journal or check stubs shall also show a running balance for all funds in the account.)
We at Elite Software Corp. make updated changes to the Escrow Compliance Software to ensure everyone stays in state compliance in every state in the U.S. For the North Carolina Real Estate Brokers, we will be adding a deposit and a withdrawal ticket numbering system in the ledger card entries that will keep track of all your deposits and withdrawals and in addition will allow you to run reports that will resolve all of these issues.
North Carolina Real Estate Commission has reviewed the software and has agreed that the software can keep you in state compliance if you follow a few additional steps while using the software.
1) Prepare a separate bank deposit ticket for each earnest money deposit.
2) Write a separate check for the disbursement of each earnest money deposit.
3) For each check you write, list to whom the check was written and the purpose of the check in the description section of the software ledger cards.
4) For each earnest money receipt recorded on the ledger cards, list from whom the check was received.
